1. General Provisions

1.1 These General Terms and Conditions of Sale ("General Conditions") apply to all sales of PETIT POIS PARIS products made through the website www.petitpoisparis.com.

1.2 The sale of Products covered by these General Conditions is exclusively reserved for consumers (“Customers” or “Customer”) who are individuals not acting within a commercial or professional activity and are over 18 years old.

1.3 The contract language can be either French or English.

1.4 Customers must carefully read these General Conditions, which can be viewed on the website, saved, and printed. A copy of the General Conditions will be sent to the Customer by PETIT POIS PARIS in accordance with Article 5.10. Sales contracts will be archived by PETIT POIS PARIS for the period required by applicable law.

2. Supplier Identification

3. Product Information and Availability

3.1 The website provides information about the Products (including relevant product codes) and applicable prices.

3.2 PETIT POIS PARIS reserves the right at any time to limit the quantities and/or types of Products available on its website. Styles, models, and colors may change without notice. During the purchase process, an automated message will notify the Customer if a Product is unavailable. PETIT POIS PARIS is not liable for unavailability before contract conclusion.

3.3 A maximum of three units of each Product may be included in a Customer’s order.

3.4 PETIT POIS PARIS cannot be held liable for errors resulting from connectivity issues on the Customer’s side.

3.5 E-Gift Card:

  • Represents prepaid monetary value for use on the website.

  • Valid for one year from the date of purchase.

  • Can be used multiple times until the balance is used up.

  • Non-refundable, non-exchangeable, cannot be reloaded.

  • Cannot be used to purchase another gift card.

  • Refunds for returned purchases made with gift cards will be issued as store credit.

4. Prices

4.1 Prices are shown in Euros, inclusive of all applicable taxes and charges. Delivery fees (if any) will be listed separately in the order form.

4.2 PETIT POIS PARIS regularly checks price accuracy but cannot guarantee the absence of errors. In case of a pricing error, the order may be refused or the Customer may be offered the correct price. If the error is detected post-confirmation, cancellation will also be possible.

5. Contract Execution

5.1 Essential characteristics and prices are displayed on the website. The website content does not constitute an offer.

5.2 Customers must read all instructions, including delivery fees, withdrawal rights, and privacy policies, before placing an order.

5.3 To purchase, the Customer must:
(i) add Products to the cart,
(ii) complete the order proposal,
(iii) choose a payment method,
(iv) accept the Terms and Conditions, and
(v) submit the order proposal.

5.4 Submission of the order is a binding offer and obligates the Customer to pay, subject to withdrawal rights (see Article 10).

5.5 The Customer can review and correct errors before submitting the order.

5.6 Order proposals and related Customer data will be retained as per applicable law and privacy policy.

PETIT POIS PARIS can refuse orders within 30 days for reasons such as unavailability, suspected fraud, or prior contract violations.

5.8 The contract is concluded when PETIT POIS PARIS accepts the order and sends a confirmation email.

5.9 If a Product is unavailable, the Customer will be informed and charged only for available Products.

5.10 The order confirmation will include product details, pricing, delivery charges, return and withdrawal policies, and contact information.

5.11 Once the confirmation is sent, the order cannot be canceled or modified, but returns are possible per Article 10.

5.12 Risk of loss or damage transfers to the Customer upon physical receipt.

6. Payment Methods

6.1 Payment (including taxes and delivery fees) can be made using:

  • Credit Card

  • STRIPE

  • PayPal

  • Cheque

  • Cash

  • E-Gift Card

6.2 Accepted credit cards: Visa, Mastercard, American Express, Discover, Diners, CUP, JCB, Maestro.

6.3 Cards are charged only after verification, authorization, and product availability.

6.4 For customized products, cards are charged post-verification and authorization only.

6.5 No charge is made upon order submission except for temporary card validation fees.

6.6 If payment fails, the contract is void and the order is canceled.

6.7 An invoice will be sent by email or post and cannot be altered after issuance.

7. Transport and Delivery

7.1 Products are delivered on business days by a courier chosen by PETIT POIS PARIS to the address in the order.

7.2 Delivery is within 2-5 days unless exceptional circumstances arise. Failure to deliver allows for contract cancellation and full refund.

7.3 Upon delivery, the Customer must:
(i) verify the number of items,
(ii) check packaging integrity,
(iii) sign for receipt,
(iv) provide ID if requested.
Any issues must be noted on the delivery receipt.

7.4 Delivery charges, if applicable, will be listed separately on the order and invoice.

8. Shipping and Delivery Confirmation

8.1 PETIT POIS PARIS will send the Customer a shipping confirmation and a separate delivery confirmation via email.

9. Wrapping and Packaging

9.1 Standard PETIT POIS PARIS packaging is used.

9.2 Gift Wrapping Options:

  • Gift Box: Tissue paper + closed box.

  • Gift Bag: Tissue paper + gift bag.
    Options are selectable at checkout.

10. Right of Withdrawal

10.1 Customers may withdraw from the contract within 14 days of receiving the product(s), or the last product in case of partial delivery.

10.2 To withdraw, the Customer must email or mail:

  • the withdrawal form, or

  • a communication indicating the intention to withdraw, including:
    (i) the product,
    (ii) order number,
    (iii) IBAN if paid by bank transfer.

10.3 Within 14 days of withdrawal notice, the Customer must return the Product(s) in original, unused condition with all original tags. Return shipping costs are the Customer’s responsibility. PETIT POIS PARIS may reject returns if the item value is diminished due to improper handling.

10.4 PETIT POIS PARIS will refund all payments (including standard shipping) within 14 days of receiving the return or proof of return, using the same payment method unless otherwise agreed.

11. Personalized Products

11.1 Per Article L121-21-8 of the Consumer Code, the right of withdrawal does not apply to:
(i) personalized items (e.g. initials),
(ii) perishable items,
(iii) items opened or used that can’t be returned for hygiene reasons.

12. Product Replacement (continued)

12.1 (continued) (…) the Client must contact PETIT POIS PARIS within 14 days from the delivery date of the Products, by sending an email to: contact@petitpoisparis.fr, and must provide:

  • the order number,

  • the Product(s) to be replaced,

  • the reason(s) for the replacement request.

12.2 The Product to be replaced must be returned to PETIT POIS PARIS in its original condition, unused, undamaged, with its original packaging and tags. Return shipping costs and the cost of shipping the replacement are at the Client’s expense, unless otherwise stated by PETIT POIS PARIS.

12.3 Replacement is subject to Product availability in stock. If the requested Product is no longer available, PETIT POIS PARIS will offer an alternative or issue a refund, according to the Client’s preference.

13. Lack of conformity

13.1 In accordance with Articles L.217-3 and following of the French Consumer Code, PETIT POIS PARIS is responsible for delivering Products that conform to the contract, free from any lack of conformity at the time of delivery.

13.2 The Client benefits from a two-year legal warranty period from the date of delivery to assert any claim related to lack of conformity.

13.3 In the event of a lack of conformity, the Client may request replacement or repair of the Product. If these options are impossible or disproportionate, the Client may request a price reduction or the cancellation of the contract.

13.4 Products that have been altered, modified, or used improperly by the Client are not eligible for this warranty.

14. Authenticity guarantee and intellectual property rights

14.1 PETIT POIS PARIS guarantees the authenticity of all Products sold on its website.

14.2 The PETIT POIS PARIS trademark, along with all other distinctive signs featured on the website, including domain names, images, logos, designs, models, texts, and all other content, are protected by intellectual property laws and are the exclusive property of PETIT POIS PARIS.

14.3 Any reproduction or use, in whole or in part, without prior written authorization is strictly prohibited.

15. Applicable law and jurisdiction

15.1 These Terms and Conditions are governed by French law.

15.2 In the event of a dispute, an amicable solution will be sought first. If no resolution is reached, the competent French courts will have jurisdiction. The appropriate court is the one in the Client’s place of residence or the place of actual delivery of the Product.

Consumer mediation refers to an out-of-court dispute resolution process, in which a consumer and a professional attempt to reach an amicable agreement to resolve a dispute between them, with the help of a third party—the mediator. If no agreement is reached, the mediator proposes a solution to resolve the dispute.

This process offers an alternative to legal action, which is often lengthy and costly. However, the consumer still has the right to take the matter to court if mediation does not lead to a resolution.

⚠️ IMPORTANT:
The referral to the Mediator must be made within one year of the consumer’s written complaint to the professional.
This referral is only possible if the professional fails to respond within 60 days or issues a negative response.
